Estado de ira no justifica aplicar justicia por mano propia
La Corte Suprema de Justicia confirmó la condena impuesta a dos hombres por el secuestro simple agravado de una mujer a la que mantuvieron retenida en un motel durante 14 horas, acusada de robarles $ 70 millones y a quien sometieron a agresiones físicas y presiones. Al no lograr que la mujer les diera información, la llevaron a su casa en donde la siguieron agrediendo y la amenazaron con hacerle daño a su familia.
La Sala Penal confirmó la decisión de primera y segunda instancia, cuestionó la llamada justicia por mano propia y señaló que no se puede legitimar la violencia como forma de resolver conflictos, pues esto erosiona la institucionalidad y desconoce el derecho de sanción o ius puniendi que radica en cabeza del Estado, en su función constitucional de asegurar la convivencia pacífica y la vigencia de un orden justo.
Y es que, en ejercicio de dicha prerrogativa, le está permitido al Estado, a través de sus jueces, imponer penas, una vez se demuestre la culpabilidad del sujeto y esté derruida su presunción de inocencia, en curso de lo cual las autoridades deben proceder con respeto de los derechos fundamentales del procesado, en especial a la integridad y dignidad humana, legalidad, debido proceso y las formas propias de cada juicio.
Justicia por mano propia
En ese orden surge evidente que la justicia por mano propia repercute en la responsabilidad penal de quien la imparte, pues siendo una conducta contraria a derecho, que atenta contra bienes jurídicos del ilegalmente enjuiciado, conlleva la respectiva investigación y juzgamiento, a partir del tipo penal que se adecúe al comportamiento antijurídico y culpable de quien la lleve a cabo, indica la providencia.
Ahora bien, sobre el argumento de que los hombres actuaron llevados por la ira, el alto tribunal señaló que la reducción de la pena contenida en la ley encuentra justificación en que el sujeto ha obrado en un estado de obnubilación que le impide razonar, si se quiere, bajo una conciencia y voluntad aminorada, a diferencia del que imparte justicia por mano propia, pues este, con pleno entendimiento decide situarse al margen de las vías legales para actuar antijurídicamente.
En el caso bajo análisis, añadió, los procesados no tuvieron la obnubilación emocional propia de la ira como atenuante y, por el contrario, resolvieron secuestrar y torturar a la mujer acusándola de hurto en lugar de denunciarla ante la autoridad para que esta adelantara la investigación y juzgamiento, lo cual es abiertamente opuesto al ordenamiento jurídico y sus instituciones, con el fin de procurar una supuesta justicia más eficaz y expedita (M.
