Precisan contabilización de términos de notificación de providencias por medios electrónicos

La notificación por medios electrónicos se entiende realizada una vez transcurridos dos días hábiles siguientes al envío del mensaje de datos, los cuales, en los términos del CPACA, empezarán a contarse cuando el iniciador recepcione acuse de recibo o, en su defecto, pueda por otro medio establecerse que el destinatario tuvo acceso al mensaje.

Se publicó el texto de la Corte Constitucional que reiteró la interpretación de la regla para contabilizar términos de notificación de providencias por medios electrónicos y confirmar unos fallos de tutela que negaron el amparo solicitado de los derechos de acceso a la administración de justicia y debido proceso, entre otros. 

Según el demandante, sus derechos fueron vulnerados tanto por el tribunal cuestionado, al rechazar la apelación interpuesta contra la sentencia de primera instancia dictada dentro de un proceso de nulidad y restablecimiento del derecho y no reponer la decisión, como por el Consejo de Estado, al negar el recurso de queja.

El alto tribunal encontró que las autoridades accionadas no incurrieron en los defectos alegados por el accionante, porque tal como lo sostuvieron los jueces dentro del proceso de nulidad y restablecimiento del derecho la norma aplicable al caso concreto es el artículo 205 del CPACA, cuyo contenido y alcance habría sido delimitado en el Auto de Unificación del 29 de noviembre del 2023 (M. P. Antonio José Lizarazo Ocampo).
